Florida Realtors Associate General Counsel, Joel Maxson, has compiled a list of the top 10 most frequently asked questions for the Legal Hotline which will be reviewed during this course. The Florida Realtors Legal Hotline is a service available exclusively to Florida Realtors members.
Objectives: After taking this class students will be able to:
- Understand the three points where the team advertising rule at 61J2-10.028 adds to the existing advertising rule at F.A.C. 61J2-10.025.
- Name three or more factors used to determine procuring cause.
- Identify the key agreement that determines an associate’s right to compensation.
- Complete three exercises calculating the effective date and one deadline using a Florida Realtors/Florida Bar “AS IS” Residential Contract for Sale and Purchase.
- Understand the duty to present offers and the recently added duty for Realtors to confirm compliance with this rule upon written demand by another Realtor.
- Explain the three main options when a seller requests an early termination to a listing agreement.
- Explain whether the property can be relisted while there is an unresolved dispute from a former purchase that failed to close.
- Pinpoint the time when an offer of compensation in the MLS becomes binding on the brokerage company that procures a successful transaction.
- Explain the core concept that undergirds issues related to emotional support animals
- Understand the breadth of the restriction against sharing commission with an unlicensed person for a referral found in Florida Statutes §475.25(1)(h).
Instructor:
Joel Maxson is currently Associate General Counsel for Florida Realtors. He has been a lawyer for Florida Realtors since 2011. Before joining the Realtor family, he was an associate at a national law firm, where he practiced real estate law. His first job after law school was as a Judge Advocate for the United States Marine Corps, where he received a broad range of legal experience.
He received his law degree from the University of Florida.
He and his wife Marnie live in Winter Park, Florida, a few blocks from where his great-grandparents settled in the early 1900s.
